These terms of use govern the platform services of Tickagain GmbH, CHE-199.188.367, Waldeggstrasse 34, 3097 Liebefeld, Switzerland. If you have any questions, complaints or objections, please contact our German and English-speaking customer service by e-mail at info@uhrreparatur.ch.

By accessing the website and using the platform, you declare that you have read and understood these terms of use and agree to them in full. If you do not agree, please leave the website.

These Terms of Use govern the provision and use of the platform offered by Tickagain GmbH for the provision of repairs, revisions and maintenance services for watches. They may be supplemented by special terms and conditions, which shall take precedence in case of doubt. The current version of the privacy policy also applies.

In the event of discrepancies or translation errors between different language versions of these Terms of Use, the German-language version shall prevail.

1. definitions and interpretation

  • Website: www.uhrreparatur.ch, www.app.uhrreparatur.ch and all associated subdomains.
  • Tickagain GmbH: Tickagain GmbH, Waldeggstrasse 34, 3097 Liebefeld, Switzerland.
  • Platform: All online services provided by Tickagain GmbH, including the website and the app, which serve to broker repair, overhaul and maintenance services for watches. This includes in particular the provision of functions for contacting providers, the presentation of offers and the handling of service processes.
  • Users: People who visit the website or use the platform (customers and providers).
  • Content: Texts, graphics, images, audio files, videos, software, data collections and other information available on the website.
  • Service: All facilities, tools, services or information offered online by Tickagain GmbH.
  • System: Any online communication infrastructure provided by Tickagain GmbH (e.g. webmail, forums, live chat).
  • Providers: Qualified Swiss watch workshops that offer services via the platform.
  • Customers: Users who make use of repair and maintenance services via the platform.

2. platform utilization

2.1 Scope of services

The platform mediates between users and qualified Swiss watch workshops that offer repairs, overhauls and maintenance of watches. The aim is to facilitate the selection of suitable service providers and support the handling of service processes.

Procedure:

  • Registration and service request: Users register and create a service request (including uploading photos of the watch, details of desired services and personal data).
  • Non-binding estimate: The user receives an initial non-binding estimate of the costs and duration of the service. Tickagain GmbH reserves the right to refuse requests.
  • Request transport box: Users can request an insured transport box for shipping the watch to the selected provider. Please note that insurance cover for the shipment of your watch is only guaranteed if you use the shipping box we provide.
  • Binding cost estimate: The supplier shall prepare a binding cost estimate after examining the watch. The cost estimate is binding as soon as it is accepted by the customer. The examination of the watch may include a detailed diagnosis, for which the provider may disassemble the watch. If the cost estimate is rejected, the watch will be returned to the customer free of charge.
  • Acceptance or rejection: Users can accept or reject the cost estimate. In the event of rejection, the watch will be returned free of charge.
  • Status updates: Users receive all information about the repair (status, cost estimate, invoices) via the platform.

Tickagain GmbH acts solely as an intermediary between the users and the providers of watch repair services. The responsibility for the execution and quality of the services lies entirely with the provider. Tickagain GmbH accepts no liability whatsoever for any damage caused by faulty or inadequate execution of the services, unless Tickagain GmbH acts with gross negligence or willful intent.

2.2 Remuneration

Use of the platform is generally free of charge for customers. Costs for repairs and maintenance are determined by the respective workshops and charged directly to the customer. The platform itself may offer additional paid features or premium membership plans, which may be subject to special conditions. These conditions will be disclosed during the registration process or in other communications to users.

2.3 Accuracy, completeness and timeliness of the information

All information and documents on the website, including the content provided on the pages in the social networks, are for guidance only. Tickagain GmbH endeavors to keep all information on the platform accurate and up to date, but makes no warranty or representation as to its accuracy, completeness or timeliness. Users are encouraged to independently verify all information provided before making any decisions based on it. It is expressly pointed out that users should check all information on their own responsibility before making decisions on the basis of the content provided. Use of the information published on the website is at the user's own risk.

3. dispatch, depot, delivery and security

  • Deposit for shipping box: To receive a shipping box, the customer pays a deposit of CHF 29.90. Payment is made via common payment methods such as credit card or Twint, which can be selected during the ordering process. Once payment has been received, the shipping box will be sent to the delivery address specified by the customer within Switzerland and Liechtenstein. The delivery time is usually 2 to 4 working days from the order date.
  • Obligation to accept: After approval of the binding cost estimate via the platform and receipt of the invoice, the customer is obliged to accept the goods or services. After acceptance of the cost estimate, change requests and cancellations can only be considered at the discretion of the provider and on a voluntary basis.
  • Quantity differences and missing deliveries: Obvious quantity differences or transportation damage must be reported to the transportation company immediately upon receipt of the goods. Hidden quantity differences must be reported in writing to Tickagain GmbH within five (5) days of receipt. If the delivery or consignment does not reach the Client after five (5) working days despite confirmation of dispatch, the Client must contact Tickagain GmbH immediately.
  • Insurance cover: Watches that are properly sent in the shipping box provided are insured up to a maximum current value of CHF 25,000 when sent and returned. If a higher insurance value is required, the customer must apply for this prior to shipment. In such cases, an individual insurance amount will be determined for an additional charge and requires written confirmation from Tickagain GmbH. For security reasons, the Client must not indicate the value of the contents or any reference to it on the packaging in order to minimize the risk of loss or theft.‍
  • Transport damage: If goods are delivered with obvious transport damage, the Customer is obliged to report this immediately to the transport company and Tickagain GmbH. If the Client fails to make a report, this shall have no effect on the Client's statutory claims, in particular warranty rights. However, the Client shall support Tickagain GmbH in asserting any claims against the transport company or the transport insurance.‍
  • Obligation to provide evidence of the current value: The Client is obliged to state and document the current value of the watch as accurately as possible upon request by Tickagain GmbH (e.g. by means of sales or purchase receipts, photos, appraisals). Direct agreements between the Client and the provider designated by Tickagain GmbH are not permitted and require the written approval of Tickagain GmbH.
  • Returns and shipping costs: Tickagain GmbH shall bear the costs of returning the watches, provided that the customer uses the prepaid return label and the shipping box supplied. If a different packaging or label is used, the customer bears the full costs as well as the liability and insurance of the package. The customer is liable for any damage caused by improper packaging on the part of the customer.
  • Use of the return label: The prepaid return label must be used for insurance and liability reasons. If the customer does not use it, he is liable for the full value of the watch sent. In this case, Tickagain GmbH accepts no responsibility for loss, damage, shipment to an incorrect address or delays in delivery. The customer is responsible for insuring the watch during transportation if the return label is not used.
  • Exclusion of liability for self-delivery and personal delivery: Insurance cover for the shipment of your watch is only guaranteed if you use our shipping box and the shipping label provided by us. Tickagain GmbH accepts no liability for damage, loss or theft or for any costs incurred by the service partner if you choose the self-delivery or personal delivery options. In such cases, all costs and risks associated with shipping or personal delivery shall be borne entirely by the customer.

4. cost estimate and service execution

  • Cost estimate: Upon receipt of the watch, the supplier will endeavor to provide a binding cost estimate within approximately 5 working days. This period may be exceeded in exceptional cases, particularly in the case of complex repairs. In such cases, the customer will be informed immediately.
  • Rejection of work: Tickagain GmbH and the respective providers reserve the right to refuse work on certain watches if there are technical, economic or other objective reasons that make professional repair impossible or unreasonably difficult.
  • Return in the event of rejection of the cost estimate: If the customer rejects the cost estimate, the watch sent in will be returned in the shipping box to the address specified by the customer. After receipt of the watch, the customer is obliged to return the shipping box to Tickagain GmbH, Waldeggstrasse 34, 3097 Liebefeld, Switzerland within 30 days. The return costs shall be borne by the customer. If the empty shipping box is not returned within the deadline, the right to a refund of the deposit amount of CHF 29.90 expires. An extension of the return deadline can be granted on request and if there are valid reasons.
  • Deviations from the cost estimate: If unexpected additional work becomes necessary during the repair that is not included in the original cost estimate, the customer will be informed immediately by e-mail or telephone. In such cases, the customer must agree to the additional work and the associated additional costs in writing or electronically. If the additional work is rejected, the repair will be canceled and the customer is obliged to pay for the services provided up to that point.
  • Carrying out the repair: Once the cost estimate has been accepted, the repair will be carried out. Once the work has been completed and the full invoice amount has been received, the watch will be returned to the customer insured.
  • Return of the shipping box after repair: After completion of the repair and receipt of the watch, the customer is obliged to return the shipping box to Tickagain GmbH within 30 days. In this case, Tickagain GmbH shall bear the costs for the return shipment. If the box is not returned within this period, the right to a refund of the deposit amount shall lapse. In certain cases, the return of the box may be omitted, about which the customer will be informed in advance.
  • Due date of the costs for collection and return delivery: The costs for a selected collection and return delivery will be charged even if the cost estimate is rejected. The corresponding invoice is due before the return delivery. In certain cases, the amount may be invoiced prior to collection.

5 Prices and terms of payment

The prices quoted on the platform are non-binding estimates that serve as a guide. The final price will be determined by the respective provider after a detailed inspection of the watch and the scope of the repair. Payments are always made directly to the provider, unless expressly agreed otherwise. Payment is processed in accordance with the individual agreements between the supplier and the customer. Any additional costs, such as shipping or insurance costs, will be communicated to the customer in good time as part of the offer.

6 Exclusion of liability and warranty

Tickagain GmbH is not liable for any loss or damage that occurs during shipment or repair by the providers, unless Tickagain GmbH has caused such damage through gross negligence or willful misconduct.

The Client is responsible for complying with the insurance conditions when sending watches if the shipping labels and shipping boxes provided by Tickagain GmbH are not used. The standard insurance cover for watches sent in is up to CHF 25,000, provided that both the shipping boxes provided by Tickagain GmbH and the associated shipping labels are used. If a higher insurance value is required, this must be agreed in advance with Tickagain GmbH and requires written confirmation. Watches that are shipped independently or handed in personally are excluded from any insurance cover.

The providers bear sole responsibility for the proper execution of the repairs and the quality of the services provided. Any warranty claims must be addressed directly to the respective provider.

7. data protection

Tickagain GmbH collects and processes personal data in accordance with the applicable data protection laws of Switzerland. All data collected will be treated confidentially and used only for the purpose of enabling the use of the platform. Data will only be passed on to third parties if this is necessary to fulfill the contractual relationship or is required by law. Further details can be found in our privacy policy

8. termination of use

Tickagain GmbH reserves the right to restrict or terminate the use of the Platform if these Terms of Use are violated or if there are other serious reasons that make continued use unreasonable. In such cases, the user will be informed of the restriction or termination of use in writing or by e-mail within a reasonable period of time.

9. final provisions

These terms of use and all legal relationships arising from them are subject exclusively to Swiss law. The exclusive place of jurisdiction is Bern, Switzerland. Should any provision of these Terms of Use be invalid in whole or in part, this shall not affect the validity of the remaining provisions. In this case, the invalid provision shall be replaced by a provision that comes as close as possible to the economic purpose of the invalid provision.
